Hi, folks!

The quorum required for impeaching a governor is getting smaller and smaller by the day. I will not be shocked or unduly awed if one day, the impeachment of a governor is based on the mere swearing-in of a substitute governor of the choosing of the Chief Judge: i.e. a zero quorum of legislators!

Muchas gracias.

Dariye impeached by a 5-man House of Assembly? How many members are there in that state's House of Assembly, 7? Did they have a quorum?

______________________
Until mankind acknowledges that the best planet in the universe is not planet Earth, but Planet 1899, Nigerian governors will continue to be impeached one after the other.

A COUP D'ÉTAT!

The caption is misleading. How does one categorize the reported destitution of the Plateau state governor as an impeachment? Linguistically, that is to say constitutionally, Governor Dariye cannot be said to have been impeached by a process that is devoid of legality or is lacking in competence. Commentators and reporters alike should do well to avoid inadvertently according a dubious legitimacy to the criminal conduct of Nigeria's Caligula, also referred to as the Butcher of Aso Rock (BOAR).

The swine called Obasanjo is no doubt hoping that this latest atrocity will serve as a diversion away from the money smuggling scandal involving him and his 'pimp', Andy Uba. The BOAR and his mafia want to bury Ubagate and its ramifications. The unprecedented looting and mayhem that have been perpetrated by the bastard from Otta since 1999 do make this sadistic buffoon the number one candidate for impeachment.

The military overthrow of Governor Dariye, if confirmed, will not go unpunished. There are going to be consequences.

impeach...

–verb (used with object) 1. to accuse (a public official) before an appropriate tribunal of misconduct in office

Impeachment my foot. This is nothing but a naked dance in the market square. We shall all be alive to see where this will lead them. In as much as I wouldn't like to sound like condonning corruption, I submit that things should be done as appropriate because even in madness there is order.

This is absurd, a display of recklessness in the highest order.

Shame to the PDP and Obasanjo led FG. I don't like Dariye's actions, no sensible person should do, but that's not enough reason for a few individuals to dig a hole for everybody. Can someone not see that the offence of either Tafawa or Shagari led govt which gave the military boys the excuse to jump in has been matched, if not exceeded by Obj and his cohorts?

Can I Love Nigeria tell us what he thinks he really loves?

DARIYE IN PROPER PERSPECTIVE I HOPE DARIYE SERVE THE BALANCE OF HIS LIFE IN JAIL!

How Dariye Misused N1.6b Ecological Fund

Probe Panel Shuns Its Dissolution, Continues Sitting

FROM ISA ABDULSALAMI, JOS
IN spite of its reported dissolution by the recently appointed Chief Judge of Plateau State, the seven-man panel investigating governor Joshua Dariye, yesterday heard how he misappropriated N1.6 billion ecological fund meant for the State.

A witness, Police Inspector Musa Sunday attached to the Economic and Financial Crimes Commission (EFCC), disclosed this while appearing before the panel investigating impeachable offences against the governor.

Sunday said he was one of those who investigated the diversion of the funds by the governor, and he presented exhibits on how the money was moved and diverted; and how millions of Naira from the state Accountant-General's account were moved to Dariye's company, Ebenezer Retnan Ventures with All States Trust Bank.

The operative, who also showed how the account was opened and the money moved around, said that in the course of investigation, the Commission visited All States Trust Bank and discovered that an account known as Ebenezer Retnan Venture was opened.

"His Excellency (Joshua Dariye) did not use his name to open this account," he said. "He only signed his signature and used the name of one Daniel Haruna.

"During the course of investigation, Daniel Haruna proved to be his brother. Daniel Haruna is not a signatory to the said account. It is only the governor of Plateau State, Chief Joshua Dariye that was the signatory."

Sunday disclosed that some staff of All States Trust Bank opened the account, and they were called for interrogation.

He said: "First among them was Awe Odesa, who was the General Manager of All States Trust Bank, North, who has his office in Abuja.

"He (Odesa) was interrogated and made statements to the EFCC on the 29/11/2004. When interrogated on how he came about Ebenezer Retnan Ventures, he wrote that the governor, Dr. Joshua Chibi Dariye, was his NYSC mate and they were friends and as a result, he marketed the Bank (to the governor) and he agreed to open the account called Ebenezer Retnan Ventures."

The detective also revealed that another staff, Dorothy Ukoh, who is the Deputy General Manager of the said bank in Abuja, was also investigated, and made relevant statements on how the governor came to her bank with the ecological CBN cheque of over N1.1 billion.

He said on December 9, 2004, the Commission wrote to the Corporate Affairs Commission (CAC) to know the people behind Ebenezer Retnan Ventures.

He said that the CAC replied after its investigation that the company, Ebenezer Retnan Ventures, was not a registered company in the country.

Further, he stated that they also wrote a letter to All States Trust Bank's head office at Plot 167 in Victoria Island requesting the Statement of Accounts of Ebenezer Retnan Ventures.

The police officer maintained that the bank replied and forwarded the Statement of Accounts of the company, which was opened in 1999 had a lot of activities.

"We discovered a lodgement of N160 million CBN cheque cleared into the same account. This prompted the EFCC to carry out thorough investigation into the said account where a lot of government cheques were discovered to be cleared into the said account.

"These cheques include a lot of Lion Bank cheques that were cleared into the said Ebenezer Retnan Ventures account."

He stated that the EFCC wrote to the Managing Director of Lion Bank and got a response, emphasising that "after thorough investigation, we discovered that most of those cheques were from Plateau State's Accountant-General's account."

"This is an account owned by the state government with the then Lion Bank," the officer added.

Before this testimony, there was a drama when Solomon Umoh, counsel to Michael Dapianlong, wanted to proceed with his witness, Sunday. But Pius Akubo, for the Simeon Lalong group of legislators, told the panel that they could not proceed until some issues were cleared.

Akubo drew the attention of the panel to its dissolution by the state government, arguing that consequently, another witness could not be called.

But the panel chairman, Samchi, thanked Akubo, saying that "no court can stop us from going on and nobody can stop us from going on."

At this juncture, Akubo said he was not talking about any court order stopping the panel but that the authority that set up the panel had dissolved it, adding that in view of that development, it would be unfair to take another witness.

However, when the panel chairman asked Umoh to comment, he told the panel that not even the Chief Judge of the state could stop the panel from proceeding.

At this juncture, the chairman overruled Akubo and asked Umoh to proceed with his witness's evidence.

The panel has adjourned till tomorrow by noon, to allow the Court of Appeal to rule on the preliminary objection raised by Umoh

How Dariye looted treasury –EFCC
By Paul Mumeh, Abuja and Onoja Audu, Jos

The Economic and Financial Crimes Commission (EFCC) on Saturday provided detailed account of how embattled Governor Joshua Dariye of Plateau allegedly diverted the sum of over N1,161,162,900 ecological fund meant for the state to his personal use.

An official of the commission, Inspector Sunday Musa while testifying before the 7-man probe panel at the old Government Lodge, Jos claimed that most of the funds were diverted through the use of companies allegedly owned by the governor.

Inspector Musa said that of the about N1.2 billion, the sum of N250 million was disbursed on the orders of Governor Dariye from All States Trust Bank, Abuja branch to Pinnacle Communication Limited’s account; Ebenezer Retnan Ventures N176 million; Union Homes, N80 million; Peoples Democratic Party (PDP) South-West N100 million while only the sum of N550 million was paid into the account of Plateau State government.

According to the EFCC official, there were other disbursements made from other funds of the state without evidence of projects executed by the companies into whose accounts the funds were paid.

He stressed that the former Accountant General of the state, Mr. Nuhu Madaki, within a few months, personally cashed over N503 million from the bank.

The policeman told the panel that investigations by the EFCC on Governor Dariye commenced in 2004 when a request was made to the agency from the office of the Attorney-General of the Federation and Minister of Justice.

According to him, his organisation (EFCC) had recovered some of the monies diverted from the ecological fund, adding that the sum of N80 million paid to Union Home was traced to one Dr. Kingsley Okomah.

Of the N100 million traced to PDP South-West, he said that the money was actually raised in favour of Marine Float, a company owned by Vice President Atiku Abubakar.

Musa identified the defunct All States Trust Bank and Lion Bank as well as Diamond Bank as institutions where Ebenezer Retnant Ventures had a lot of financial activities with accounts opened with different names, but had Dariye as signatory.

He further alleged that a lot of property and shares were manipulated to be used in the nearest future.

At the commencement of the Saturday sitting of the panel, counsel to Mike Dapialong faction of the House of Assembly, Solomon Umoh, informed the panel that Detective Peter Clerk who was cross-examined for four hours on Friday by Governor Dariye’s counsel, Pius Akubo (SAN), had left the shores of Nigeria to London to resume duty on Monday.

But Akubo expressed shock at the sudden departure of Clerk, insisting that he was yet to finish his cross examination of the London Metropolitan Police detective and demanded that he should be summoned back before the panel.

The counsel also asked the panel to wind up its sitting since it had been dissolved by the new acting Chief Judge, Ibrahim Yau Dakwang.

Reacting to the claim of Dariye counsel, chairman of the panel, Mr. Mark Samchi, noted that the machinery that set up the panel did not in any way asked for the dissolution of the panel and as such nothing will stop them from completing the task ahead of them.

However, the panel chairman disagreed with the request for the return of Clerk, and adjourned sitting till 12.00 noon Monday for cross examination of Inspector Musa by Dariye’s counsel.

In a similar vein, Micheal Diaplong, has asked Dariye to reverse the sack order slammed on the sacked acting Chief Judge of the state Justice Lazarus Dakien or face the consequences.

Diaplong insisted that Dariye did not secure the 2/3 majority of members of the state House of Assembly nor did he act on the recommendation of the National Judicial Council (NJC) to enable him sack the state Chief Judge.

He therefore pleaded with the Chief Justice of the Federation, Justice Alfa Belgore, to intervene and restore sanity to the state judiciary.

Diaplong hinted that the state House of Assembly would reconvene for an emergency session to tackle the matter, saying that Dariye who had been canvassing for rule of law could not turn round to subvert the constitution to further his personal interest.

"We are amazed by the governor’s flagrant abuse of the rule of law. We have had enough of this recklessness and we must stop it," Diaplong vowed.

Hi Folks,
This is one of the most trying times in the history of democracy in our country.Never in any situation has democracy been ridiculed, mocked and trampled upon like it is being done in our beloved country Nigeria today.Yet one person who calls himself I Love Nigeria is happy that Democracy is beind destroyed in the name of bringing corrupt public officers to book. This is disheartning.

I heve the priviledge of provinding a first hand information on the situation in plateau state. It is undeniable that Gov Joshua chibi Dariye is doing little or nothing in the state. It is undeniable that Gov Joshua chibi Dariye cares less about the poverty striken people of plateau state. It is undeniable that Gov Joshua chibi Dariye has no master plan for the health sector of the state. It is undeniable that Gov Joshua chibi Dariye is owing school teachers some months salary. It is undeniable that Gov Joshua chibi Dariye has left the roads in the state in a terible condition compared to what is obtainable in neighbouring states like Bauchi and Kaduna. With all these, we have every reason to say Gov Joshua chibi Dariye is no longer fit to govern the state as he has failed in delivering to the people of the state. But the big question is:what method should be adopted in removing him.

I make bold to say that all the processes and the methods adopted in removing Gov Joshua chibi Dariye is totally unconstitutional, illegal, null and void.It smacks short of what the constitution states.

Yours Sincerely
