INEC Bans Atiku: It’s All Part of Third Term Agenda - AC

The Independent National Electoral Commission (INEC) may have finally dealt a dead blow on the presidential ambition of Vice President Atiku Abubakar as it released guidelines on who and who will be qualified for the April general election. According to INEC, according to INEC, any  candidate who has been indicted for fraudulent practices either by a judicial or administrative panel accepted by the Federal Government will not feature in the April general elections. By this, Alhaji Atiku Abubakar is out of the election. The INEC made this known yesterday through its Chairman of Legal Services, M.A Abubakar, insisting that it would invoke relevant sections of the constitution in baring candidates of questionable characters from participating in the coming elections. According to INEC, the steps it would take in disqualifying erring candidates has been spelt out clearly by the Nigerian constitution, most especially sections 65,106 and 177 with back ups in sections 66,101,137 and 182.

 

The vice president ,Alhaji Atiku Abubakar remains the only presidential candidate alleged of fraudulent practices by the Federal Government through an administrative panel. A gazette to that effect has been produced by the Federal Government. While INEC did not allude to Atiku specifically, his campaign organization has consistently drummed it in the media that the vice president is not guilty of any such offence as alleged by the Federal Government. 

Also the INEC announced that it would commence the verification of the information and documents submitted to it by different candidates beginning from January 10 to January 23. The verification of particulars of candidates for the states and National Assembly elections, according to INEC, would be held at the state level between January 10 and 17. The Commission said the verification of particulars of the governorship aspirants would be held in their respective states between January 19 and 21, while all presidential candidates would have their own particulars screened between January 22-23.

Instructively, INEC stated that it would also invoke punitive sanctions on political parties who presented candidates with questionable credentials to it. The INEC, however, called on members of the public to assist it in scrutinizing the particulars of the political office seekers with a view to taking individual actions on how to stop such candidates. Said the INEC legal chief, “Nigerians should, therefore, seize the opportunity of the verification exercise to respond to the particulars submitted by the candidates and raise complaint” against any one they might have found guilty of fraudulent conducts.

“The court can place a levy of N5 million on any political party that presents candidates not qualified to participate in an election based on forge particulars”. It stressed, therefore, that every intended substitution by the parties must be accompanied by cogent verification reasons. The parties, INEC stressed, will verify their substitution between February 5-13, this year. In a swift reaction, however the Action Congress (AC) denounced the standpoint by the INEC, stating that the commission has no constitutional right to either screen or verify any candidate aspiring to political offices in Nigeria . The AC legal Adviser, Dr. Mrs. Ego Ezuma attributed the new position of INEC to the “undying third term agenda” which she said necessitated disqualification of politicians who fought to kill the agenda” She said in a chat with Saturday Tribune, “The whole thing is a ruse. It is intended towards disqualifying most of our members from participation in the next general election.

Presidency: We’ll Await Court Verdict on Atiku

For the second time in three days, the Presi-dency has clarified its position over whether Vice President Atiku Abu-bakar remains the nation's number two citizens or not after defecting to the Action Congress (AC) to contest the 2007 presidential election.
The Presidency said on Saturday that its stand was to wait for the pronouncement of the Court of Appeal on its suit seeking a legal interpretation of the 1999 Constitution on the matter.

The Presidency, also stated that it had not at any time given permission to any person to speak on its behalf on the issue apart from the decision taken by the Peoples Democratic Party (PDP) and the Attorney-general of the Federation and Minister of Justice, Mr. Bayo Ojo (SAN).

Speaking through Mrs. Oluremi Oyo, Senior Special Assistant to the President on Media and Publicity, the Presidency however kept mute on whether or not Atiku whose official aides have since been recalled back to the mainstream of the Federal Civil Service, would come back to his office when he returns from vacation in the United States.
Oyo said the Presidency "has not authorized any other comment on this matter other than the decisions and action of the PDP (Peoples Democratic Party) and the Attorney-General of the Federation (Chief Bayo Ojo) who took the matter to the Court of Appeal for interpretation)."

In a statement in Abuja, Oyo said such clarification "on the current status of Alhaji Atiku Abubakar in the present Administration" became necessary because of the recent reports and comments in the media on the issue.
The Senior Special Assistant stated as follows:

"•At its last meeting in December 2006, the National Executive Committee of the ruling Peoples Democratic Party (PDP) decided to regard Alhaji Atiku Abubakar's acceptance of his nomination as presidential candidate of the Action Congress as clear evidence of his voluntary abandonment of the PDP and the joint ticket with President Olusegun Obasanjo that made him Vice President.
"•The PDP NEC further decided that because of his voluntary desertion of the party, Atiku Abubakar is no longer a member of the PDP.
"•These decisions were subsequently conveyed to Chief Olusegun Obasanjo in his capacity as President of Nigeria and Leader of the PDP, as well as to the Independent National Electoral Commission (INEC) and the National Assembly.
"•Consequent upon these decisions and action, the Minister of Justice and Attorney-General of the Federation has asked the Court of Appeal for a legal interpretation of the Nigerian Constitution of 1999 in this regard.
"•The Presidency has not authorized any other comment on this matter other than the decisions and action of the PDP and the Attorney-General of the Federation."
Reacting to Oyo's statement last night, the Director of Media and Publicity of Atiku Campaign Organ-isation, Mallam Garba Shehu said it was interesting to note that the Presidency now recognises the court.

"For us we have always had confidence in the court and recognised that just like the executive, the judiciary should be allowed to do its job. If indeed there is honour in President's spokesman, Uba, he should resign his job," Shehu said.
The Special Assistant to the President on Public Affairs, Mallam Uba Sani, had last December 23, told newsmen in Abuja that President Obasanjo had declared the office of Vice President vacant adding that a replacement would soon be found for Atiku.

The move was sequel to the decision of Atiku to defect to AC where he later emerged the party's presidential candidate in the forthcoming presidential elections.

Last week, the honourary Political Adviser to the President, Chief Akin Osuntokun was quoted as saying that President Obasanjo had not declared the seat of Vice President vacant. Osuntokun however said later that he was misquoted by the press.

Meanwhile, a member of the House of Represen-tatives from Plateau State, Rev John Longhor, has said the National Assembly is ready to take President Olusegun Obasanjo head on over the issue of the office of the Vice President when it reconvenes on January 16.

In an interview with newsmen in London, Longhor said, "The national assembly will fight this illegality and about 95% of my colleagues I've spoken to are ready to take actions once we reconvene on January 16th."

According to the House of Representatives member, "Sections 308 and 142 -148 of the constitution are very clear on it. The vice president is not an appointee of the president, he is an elected VP and it is the responsibility of the representatives -Senate and House of Representatives, to sack the Vice president through impeachment, where the need arises. Atiku can only be removed by death, sickness or by the National assembly. If Atiku has done anything impeachable, what Obasanjo should have done is to take the matter to the National assembly, it is their responsibility."

On Atiku's decamping to the Action Congress (AC), the House member said "moving from one party to another is not an offence and Atiku is free to associate with another party.

Obasanjo Is Confused - Atiku

Vice president Abubakar Atiku who is holidaying in the United States has described President Olusegun Obasanjo as a “confused man” over the double speak that emanated from the two of his aides on the issue of the position of the Vice President’s office.

Presidential aide, Uba Sani had quoted the Federal Government as having declared the Vice-President’s seat vacant following the defection of Alhaji Atiku to the Action Congress and his eventual adoption as the party’s presidential flagbearer.

But on Wednesday, the Presidency capitulated with the Political Adviser to President Olusegun Obasanjo, Chief Akin Osuntokun appearing on a national television and saying that the seat was never declared vacant and blamed the media for the misinterpretation of the government’s intention.

According to him, what the Presidency did was to write the Peoples Democratic Party (PDP) and the National Assembly, intimating them of the move to approach the court to declare the seat vacant.

However, Atiku’s spokesman, Mallam Garba Shehu said in Abuja that the Vice President was not surprised at the sudden change of stand of the Presidency over the purported declaration of the VP’s seat as vacant.

Said he: "From the look of things, their uncoordinated acts suggest that they are confused and divided, and therefore have to change their tactics."

Shehu told Daily Sun that the simple interpretation of the reading of the situation is that the Presidency probably must have realised its folly over some of the steps taken so far.

He explained that as a democrat, Alhaji Atiku Abubakar would continue to rely on the courts to fight his battles and would continue to win as he has been winning.

Amidst rumour that Atiku might not return to the country because of fear of possible arrest, Mallam Shehu debunked the insinuations, saying his principal would soon be back to face his presidential campaign.

"The VP will be back as soon as he finishes his vacation," he said.

The world’s most powerful nation, the United States, has intervened in the on-going war between President Olusegun Obasanjo and Vice President Atiku Abubakar, warning President Obasanjo to desist from alleged plans to arrest Abubakar when he returns to Nigeria next week.

Speculations are rife in political circles that President Obasanjo is prepared to order the arrest of his vice when he returns to Nigeria, as scheduled. Presidential spokesman, Uba Sani, had, on behalf of the presidency, declared the vice president’s seat “vacant”, subsequent upon which Abubakar wrote the heads of the National Assembly and the judiciary. Only last week, in his attempt to clarify the position of the presidency which had been described by top lawyers as “unconstitutional”, another presidential spokesman, Akin Osuntokun, had reportedly claimed during an appearance on the NTA that the presidency did not declare the VP’s office vacant, but rather that the “vacancy” was occasioned by the VP’s defection from the ruling People’s Democratic Party (PDP), and his subsequent adoption as the presidential candidate of the Action Congress (AC). However, Osuntokun came out later to disclaim the statement insisting that he affirmed the VP’s office.

Sunday Tribune gat-hered from sources in Abuja and the United States that the warning was handed over to the president in “diplomatic language”. A senior official of the State Department was said to have expressed America’s displeasure with rising political tension in Nigeria, particularly in the context of the coming elections in 2007. The American official, according to our sources, told the Nigerian government that the US expects that the president will follow the due process and allow the rule of law to reign. In this context, it was “mentioned” that the US expects that since the constitutionally prescribed process of the impeachment of the vice president is yet to be followed, the US will expect that the VP will be treated “with due regard to his position and office” when he returns home.

The same sentiments were said to have been expressed by a ranking official of the United Nations to the Nigerian Mission to the UN and the presidency. However, when Sunday Tribune contacted the Public Affairs unit of the US Embassy in Lagos, the spokesperson, Mrs. Joke Omotunde, said that the Embassy has not made any statement as regards the feud between the president and his vice and does not wish to comment on the claim that Washington has expressed concern over the feud

Oyo said the Presidency "has not authorized any other comment on this matter other than the decisions and action of the PDP (Peoples Democratic Party) and the Attorney-General of the Federation (Chief Bayo Ojo) who took the matter to the Court of Appeal for interpretation)."

In a statement in Abuja, Oyo said such clarification "on the current status of Alhaji Atiku Abubakar in the present Administration" became necessary because of the recent reports and comments in the media on the issue.
The Senior Special Assistant stated as follows:

"•At its last meeting in December 2006, the National Executive Committee of the ruling Peoples Democratic Party (PDP) decided to regard Alhaji Atiku Abubakar's acceptance of his nomination as presidential candidate of the Action Congress as clear evidence of his voluntary abandonment of the PDP and the joint ticket with President Olusegun Obasanjo that made him Vice President.
"•The PDP NEC further decided that because of his voluntary desertion of the party, Atiku Abubakar is no longer a member of the PDP.
"•These decisions were subsequently conveyed to Chief Olusegun Obasanjo in his capacity as President of Nigeria and Leader of the PDP, as well as to the Independent National Electoral Commission (INEC) and the National Assembly.
"•Consequent upon these decisions and action, the Minister of Justice and Attorney-General of the Federation has asked the Court of Appeal for a legal interpretation of the Nigerian Constitution of 1999 in this regard.
"•The Presidency has not authorized any other comment on this matter other than the decisions and action of the PDP and the Attorney-General of the Federation."
Reacting to Oyo's statement last night, the Director of Media and Publicity of Atiku Campaign Organ-isation, Mallam Garba Shehu said it was interesting to note that the Presidency now recognises the court.

"For us we have always had confidence in the court and recognised that just like the executive, the judiciary should be allowed to do its job. If indeed there is honour in President's spokesman, Uba, he should resign his job," Shehu said.
The Special Assistant to the President on Public Affairs, Mallam Uba Sani, had last December 23, told newsmen in Abuja that President Obasanjo had declared the office of Vice President vacant adding that a replacement would soon be found for Atiku.

The move was sequel to the decision of Atiku to defect to AC where he later emerged the party's presidential candidate in the forthcoming presidential elections.

Last week, the honourary Political Adviser to the President, Chief Akin Osuntokun was quoted as saying that President Obasanjo had not declared the seat of Vice President vacant. Osuntokun however said later that he was misquoted by the press.

Meanwhile, a member of the House of Represen-tatives from Plateau State, Rev John Longhor, has said the National Assembly is ready to take President Olusegun Obasanjo head on over the issue of the office of the Vice President when it reconvenes on January 16.

In an interview with newsmen in London, Longhor said, "The national assembly will fight this illegality and about 95% of my colleagues I've spoken to are ready to take actions once we reconvene on January 16th."

According to the House of Representatives member, "Sections 308 and 142 -148 of the constitution are very clear on it. The vice president is not an appointee of the president, he is an elected VP and it is the responsibility of the representatives -Senate and House of Representatives, to sack the Vice president through impeachment, where the need arises. Atiku can only be removed by death, sickness or by the National assembly. If Atiku has done anything impeachable, what Obasanjo should have done is to take the matter to the National assembly, it is their responsibility."

On Atiku's decamping to the Action Congress (AC), the House member said "moving from one party to another is not an offence and Atiku is free to associate with another party.

Obasanjo Is Confused - Atiku

Vice president Abubakar Atiku who is holidaying in the United States has described President Olusegun Obasanjo as a “confused man” over the double speak that emanated from the two of his aides on the issue of the position of the Vice President’s office.

Presidential aide, Uba Sani had quoted the Federal Government as having declared the Vice-President’s seat vacant following the defection of Alhaji Atiku to the Action Congress and his eventual adoption as the party’s presidential flagbearer.

But on Wednesday, the Presidency capitulated with the Political Adviser to President Olusegun Obasanjo, Chief Akin Osuntokun appearing on a national television and saying that the seat was never declared vacant and blamed the media for the misinterpretation of the government’s intention.

According to him, what the Presidency did was to write the Peoples Democratic Party (PDP) and the National Assembly, intimating them of the move to approach the court to declare the seat vacant.

However, Atiku’s spokesman, Mallam Garba Shehu said in Abuja that the Vice President was not surprised at the sudden change of stand of the Presidency over the purported declaration of the VP’s seat as vacant.

Said he: "From the look of things, their uncoordinated acts suggest that they are confused and divided, and therefore have to change their tactics."

Shehu told Daily Sun that the simple interpretation of the reading of the situation is that the Presidency probably must have realised its folly over some of the steps taken so far.

He explained that as a democrat, Alhaji Atiku Abubakar would continue to rely on the courts to fight his battles and would continue to win as he has been winning.

Amidst rumour that Atiku might not return to the country because of fear of possible arrest, Mallam Shehu debunked the insinuations, saying his principal would soon be back to face his presidential campaign.

"The VP will be back as soon as he finishes his vacation," he said.

Don’t arrest Atiku, US, UN warn OBJ

The world’s most powerful nation, the United States, has intervened in the on-going war between President Olusegun Obasanjo and Vice President Atiku Abubakar, warning President Obasanjo to desist from alleged plans to arrest Abubakar when he returns to Nigeria next week.

Speculations are rife in political circles that President Obasanjo is prepared to order the arrest of his vice when he returns to Nigeria, as scheduled. Presidential spokesman, Uba Sani, had, on behalf of the presidency, declared the vice president’s seat “vacant”, subsequent upon which Abubakar wrote the heads of the National Assembly and the judiciary. Only last week, in his attempt to clarify the position of the presidency which had been described by top lawyers as “unconstitutional”, another presidential spokesman, Akin Osuntokun, had reportedly claimed during an appearance on the NTA that the presidency did not declare the VP’s office vacant, but rather that the “vacancy” was occasioned by the VP’s defection from the ruling People’s Democratic Party (PDP), and his subsequent adoption as the presidential candidate of the Action Congress (AC). However, Osuntokun came out later to disclaim the statement insisting that he affirmed the VP’s office.

Sunday Tribune gat-hered from sources in Abuja and the United States that the warning was handed over to the president in “diplomatic language”. A senior official of the State Department was said to have expressed America’s displeasure with rising political tension in Nigeria, particularly in the context of the coming elections in 2007. The American official, according to our sources, told the Nigerian government that the US expects that the president will follow the due process and allow the rule of law to reign. In this context, it was “mentioned” that the US expects that since the constitutionally prescribed process of the impeachment of the vice president is yet to be followed, the US will expect that the VP will be treated “with due regard to his position and office” when he returns home.

The same sentiments were said to have been expressed by a ranking official of the United Nations to the Nigerian Mission to the UN and the presidency. However, when Sunday Tribune contacted the Public Affairs unit of the US Embassy in Lagos, the spokesperson, Mrs. Joke Omotunde, said that the Embassy has not made any statement as regards the feud between the president and his vice and does not wish to comment on the claim that Washington has expressed concern over the feud
