December 13, 2004 Dear President Obasanjo: Earlier today (December 13, 2004), I read your response to Mr. Audu Ogbehs recent letter to you about the state of the nation. Frankly, sir, your response was truly disappointing. Early in the life of your administration, The Financial Times conducted a survey of Nigeria in which it described you as being in office but not in power. Everything you said in your letter to Mr. Ogbeh confirms that. Sir, by your own admission, Dr. Ngige and Mr. Uba admitted their part in a criminal conspiracy to deny the people of Anambra their electoral rights. You noted that so shocked where you that you asked them to leave your residence. You also indicated that over time you came to understand the depth of the criminal conspiracy against the people of Anambra and Nigeria. Surely sir, if Dr. Ngige as a representative of the Peoples Democratic Party falsified the results in Anambra, is it not probable that indeed the results of Anambras presidential elections were falsified? Let us set aside whether or not the results of the presidential election are genuine. What truly disappointed me about your response is that for months you have known that Mr. Uba and Dr. Ngige are co-conspirators in a criminal conspiracy, yet you remained silent. Is it not against the law you are sworn to uphold to report probable violations of Nigerias criminal code? I believe it is still a crime under Nigerian law to falsify election results. If that indeed is the case, your silence sir, has made you an accessory to the crime at best, and a co-conspirator at worst. Why did you not ask the Nigerian Police Force or Department of State Services (SSS) to investigate, given the extraordinary admission you witnessed? Sir, you have always presented yourself as a man of honor. I urge you to take the path of honor in this case: Set in place the machinery to have Mr. Uba, Dr. Ngige and their co-conspirators within the Peoples Democratic Party arrested for electoral crimes and acts of treason against Nigeria. Let the thread of evil unwind and claim the heads who sustained it, no matter how high in the official hierarchy of the republic culpability runs.Tender your resignation. You made a choice sir to be a part of what is turning out to be a criminal enterprise with tentacles across the republic but operating under the official title of a political party (PDP). Indeed, Mr. Ogbeh is right that you will be tarred with the same brush. Irrespective of your intentions, it is clear and I say this with a heavy heart, given that you where aware of the depth of the depravity at work in Anambras elections, it would be immoral for you to continue in office. Your integrity as a defender of law and order is at stake. The message your letter sent is that a crime was admitted to you, but for reasons best known to you, you did not act under the multiple provisions available to you under Nigerian law and the 1999 Constitution. If you decline to enforce the constitution, who sir will? As the officers of the republic investigate the issues raised here, it may become patently clear that the rot of electoral falsification seats deeply within your administration. In fact given the questionable circumstances surrounding Mr. Wabaras appointment as Senate president, such an outcome is not improbable. In such a situation, the morally prudent step would be to compel your entire administration to hand over power to the Chief Justice of the republic to oversee the conduct of a new election, if necessary under UN supervision. I am confident that General Buhari and General Ojukwu would gladly withdraw their legal challenge under such conditions in the interests of the stability and peace of the republic.
