Millions of Nigerian men would be jailed if the Nigerian legal age of sexual consent was raised from 13 to 16. Recently, a 41-year-old man who plied a 12-year old girl with alcohol and then raped her was released from an Irish prison and as expected this caused an uproar in the country leading to public protests. The man at the center of the sex fiasco who was 38 at the time of the offence and simply referred to as Mr. A for legal reasons had been jailed for three years in November 2004 under the statutory rape legislation whereby having sex with a girl under the age of 17 (the legal age of sexual consent in Ireland) was a criminal offence. Under the statutory rape legislation, it didn’t matter whether the girl lied about her age. Having sex with any girl under the age of 17 is illegal, period. However, last month, a Judge ruled that this provision was flawed and consequently illegal. Therefore, Mr. A, who had been serving a three year jail term under the provisions of the statutory rape legislation walked free from jail only to be rearrested later because of the huge public outcry and the quick move by the Irish Government to block the loophole by rolling out a legislation.

Some people might wonder why all these stories about statutory rape in Ireland? Well, I had to give a brief introduction into the relationship between or rather the implication of this to the Nigerian situation whereby early marriages between old men and young girls are still the order of the day. I believe the Nigerian legal age of sexual consent is 13. However, gaining carnal knowledge of a very young girl sometimes as young as 10 or 11 within or outside marriage is not seen as a criminal offence in many arenas.

Till date, early and arranged marriages are still very rampant in the Nigerian society. It is still believed in many quarters that a virgin is a pride to her family and her husband so young girls are married out early in order to prevent them from being promiscuous thereby destroying that pride before marriage. Sadly, this is one of the reasons advanced for carrying out the dastardly act of female genital mutilation as well. Chop off a girl’s genitals to prevent her from promiscuity. Although not a victim of female genital mutilation, I was a victim of an arranged early marriage and can say with confidence that the experience was not a pleasant one. My case was that of a child becoming a mum. A child who was snatched from the cradle, cajoled and introduced to adulthood against my wish. I got out of the slavery because of my willingness and determination to live a full and normal life and to provide my children with a better life, totally different from the one my father chose for me. Many young girls are not so lucky. Once that first opportunity is denied, life seems to come to a standstill for them.

There are several reasons why African men go after younger girls and I believe the principal one is greed. Catch them young so that the man can be in absolute control. These older men remote control these young girls and treat them like robots, always having the final say either because of their wealth or as a result of their age. How else can one explain my situation whereby the man I was betrothed to was 25 years older than I? The generational gap meant I was at his beck and call. Do this or that, and my answer was, yes sir! How dare you oppose him? He would beat the child-wife blue black and tell her the history of her poor family.

Another reason why I think older men go for younger girls is the belief that a young girl refreshes the blood of an older man. These girls have not been ‘corrupted sexually by other men’; therefore they are rich down below if you get my point. They are really tight (please excuse my language) as well but as one of my friend’s would say, ‘who cares about virgins; we are not in the era of virgins’. He goes further to say, at the end of the exercise, the man suffers bruises, so what is the point of it all? What is the joy of it all when all you can do is the traditional style devoid of the expertise of modern girls he further queries? (Please do not ask me what that means). Ego is my short and simple answer. Pride. The old man was there first as if possessing a young girl’s body is a competition.

Another reason is the fact that there is this belief in local parlance that a male AIDS sufferer is likely to be cured by a virgin. No wonder 15 to 29 year olds accounted for 63% of all AIDS cases between 1986 and 1995 in Nigeria! I am not sure about the statistics of older men with the disease but my guess is that they did not present themselves for medical examination.

Early sexual relationships between older men and young girls is largely responsible for the 80% drop out rate from school among teenage girls and I believe the Nigerian legal age of consent should be reviewed upwards to 17. This will make it really glaring if an older man decides to sleep with a child 5 or 6 years younger than the legal age of consent. At the moment, most of them get away with sleeping with a girl as young as 12 because of the closeness to the age of consent. Every child, male or female deserves a chance in life and Nigerian men (most of the time with pot bellies and bald heads) who go about sleeping with children must be made to answer for their actions. They are nothing but pedophiles robbing our daughters of their youth! In the same vein, parents who mortgage their daughters’ happiness by threatening and cajoling them into early marriages or sexual relationships should face a similar punishment (life in jail with hard labour).

This will make it really glaring if an older man decides to sleep with a child 5 or 6 years younger than the legal age of consent. At the moment, most of them get away with sleeping with a girl as young as 12 because of the closeness to the age of consent. How true! Lovely article. I believe the best way is to train the children as soon as they can read and write the value of their bodies. It is almost fruitless in Nigeria to expect the government, religious leaders and community leaders to change the status quo. They are the ones fueling the circle of abuse.

My emancipation came when I placed a high price on my body. I did not have sex outside of marriage and I did not condone abuse within marriage! I am prepared to let go of anyone or anything that will devalue my body, soul and spirit. I live within my means and help others to do the same. It is a choice I made based on the value I placed on my life.

The same way, if we teach our children, both males and females to value their lives, and give other people the same right, we will stop the circle of abuse, whether verbal, emotional, financial, psychological, cultural or physical.

We must continue to question and re-examine our customs and traditions from an African perspective and not from a Western perspective. Westerners tell us that circumcision is barbaric – but what about vagina tightening, facelift, labial folds nip and clitoral hoods tuck etc. If it is so barbaric, then let them start campaigning against it in the Jewish, Asian, and Muslim communities in Europe – that would be the day. Africa is always seen as a soft touch. I would love to know why you think circumcision is wrong from an African perspective.

I am 100 percent in favour of male circumcision: A circumcised genitalia is aesthetic; gives women added pleasure; and less prone to catch diseases, and I thank my African tradition and parents for it. Further, one cannot help noticing that most do-it-yourself (DIY) sex toys used by women in the West resemble the circumcised male genitalia. Now, why is this so, in a society, where a greater proportion of the male population is not circumcised?

Come on now, mankind quest for the unspoilt is as old as mankind. Put another way, the older man's (and woman's) quest for virgins is as old as mankind and is universal. AIDS is a recent phenomenon and can not be used as the reason for an age old tradition practised all around the world – whether good or bad.

No decent person would condone adult sex with a minor, and I agree that the age of consent should be raised to 17 – if not higher. The higher the age, the better we are able to protect the under 13 year-old.

13yr olds can make sexual decisions about who they want 2 sleep with, OK? No one is saying 40yr olds should b with 16yr olds, I'm making no judgement on that. What I do know is that when I was in secondary schl, plenty of 13-17 yr old females were having serious sex with 13-17 yr old males. Same here in America......I came to this country when I was in that age bracket, and I knew exactly what I was doing! :lol: Even a decade later, I still get phone calls from some of the women I disvirgined asking 4 more!

Now what? Come arrest me now, wetin u dey wait 4? Ppl should plz stop imputing innocence to ppl who have just as much lustful drive as any adult. Yes, it sounds nice. Yes, sexual abuse/rape of any kind is wrong. But, try and make a better case of it than this, abeg! :rolleyes:

Forgive me for expressing the suspicion that your article is designed merely to give credence to the reasons you gave for seeking asylum in Ireland. I recognise that I may be wrong though.

To ascribe the guilt of peadophillia to 'millions' of Nigerian men without empirical evidence is simply not right. You furter illustrate with your experience of having married a man 25 years older than you are without letting on how old you were at the time of your marriage. Your experience of being a 'child bride' appears to have had little if any negative effect on your education and achievements given the clarity of thought that wrote the article and the better than average use of English. Perhaps it lent impetus to your ambitions?

You know and it is perhaps your intention that your article will be quoted as authoritative reference for 'rampant' sexual abuse of children in Nigeria and you even allude that this heinous crime is acceptable to both government and society. Since your escape from the binds of your marriage to the geriatic, pary madam how much have you given of your intellect and your time to fight this ill of your origins that by your admissions is still affecting millions of young girls? maybe this article is a first step.

Have you by any chance seen the Child Rights Bill that was passed in Nigerian Law last year? Have you contributed to the efforts of government through NAPTIP and many, very many NGOs to stop trafficking of children and young women and thus saving them from sexual exploitation?

But I run ahead of myself. I just hate to see 'avengers' such as your self who villify their home countries from the safety of their new found havens, worse still who hold public office and should be more careful of the things they say that are not backed by hard evidence. Much as I acknowledge that children still suffer sexual and other forms exploitation in Nigeria (along with everything else that is sick in our systems) I would prefer that you give the true unbiased picture backed by hard hard evidence and not make wild claims that will cast aspersions on everyone still proud enough to wear the Nigerian flag. Better still please make concrete suggestions on how we can work to fight any of the ills that are dear enough to your heart for you to write about it instead of your treatise of condemnation.

please do not believe, let us know if this is a fact or not. It helps your agrument a lot. Also I did an internet search simple on a "12 year old girl" and waded through a few images. You'd be surpised what i found, unfortunately we can no longer post pictures in this section or I would have shared some with you.

Here is a question: Has it be medically proved (not morally mind you) that a 12 year old girl is incapbale of having sex? or that having sex at that age will affect her health? Now before you say yes consider a few truths: Most 12-13 years olds that have sex with older men is forced as you said rape, hence its is no surprise that the girls suffer physical and mental trauma. Secondly as Obugi argues, how about the millions engaging in consensual sex with others in their age group?

So asking the same question again, How was the age of consent arrived at? Who determines that a 12 year old is incapable of having sex? The girl? Her parents? Society? The courts?

Just kicking some evil thoughts around...:D

Thanks for sharing your view jare. I see nothing wrong with raising the age of sexual consent for minors, not only in Nigeria but also worldwide. Yes, laws cannot be enacted to prevent sexual intercourse between two minors who mostly cant reason beyond the immediate sexual pleasures or take into consideration the potential impact it could have on their lives. Regardless, laws must be enacted to prevent grown ass adults from jumping into that pool and taking advantage of the minors; and excuses such as "I was enticed by the minor" should never be tenable in a law court.
